"Neither obligation, however, has been helpfully defined for prosecutors."Polk, who is the chair of the Arizona Prosecuting Attorneys' Advisory Council (APAAC) said it's already the job of prosecutors to turn over new evidence that could ultimately exonerate a defendant."Our position is that we have always bent over backwards to disclose anything that is remotely exculpatory and we will always continue to do so, so this rule simply wasn't needed," Polk said.In fact, she said, it's part of the prosecution's job. "The Supreme Court of the United States has specifically said we are ministers of justice," she said, "whose greater obligation is to make sure justice is done."It's not about racking up convictions," she added.She gave the example of lead-bullet evidence. For decades, the claimed there were unique chemical properties in lead bullets that could be used to trace any individual bullet's history.
