Companies are allowed to charge only the prices they listed on a wrecker fee schedule that is filed with the state.The problem is, prices on that list are not uniform. Some companies charge a lot more than others for the same services. A simple solution would be for the towing industry to meet with law enforcement to set reasonable fees for services. If a company does not comply, it is removed from the list.Randy LeBeaumont, a representative of the Wyoming Professional Towing Association and owner of Randy s Towing in Cheyenne, recently told a legislative committee that that is not possible. He says no two tows are the same and several issues, such as the location of the tow, the damage of the vehicles and the weather conditions, all factor in to the price of a tow. While we see his point, we also think more uniformity could be agreed upon.Another solution might be to get rid of the list altogether. Allow the vehicle s owner, or a relative if the owner is injured or indisposed, to contact towing companies to find the best price.While this may not work when vehicles are smashed on the highway and they have to be removed immediately, it would in other cases, like abandoned vehicles or tows for DUIs.Even the managing director of the Wyoming Trucking Association, Sheila Foertsch, says regulations may be necessary to combat these bad actors. She said she knew of one company that charged five times what another charged for a tow.That s ridiculous. When customers are denied a say in the price, the free market breaks down. The current system almost encourages companies to gouge customers. Some companies will charge as much as they can get.But we may be getting ahead of ourselves here.While the Legislature s Joint Transportation, Highways and Military Affairs Interim Committee voted to draft a bill to place caps on towing fees, the measure has a long way to go before it would become law. Perhaps the threat of the law might be enough to get rogue towing companies to regulate themselves.Hopefully, a solution can be found other than enacting a law. If that proves impossible, all we can say is: They brought it on themselves.
